Under current Mississippi law, a DUI cannot be nonadjudicated. This means that you cannot plead it down to a lesser charge — you must win your case or face the penalties of a DUI conviction.
Important changes in Mississippi DUI law take effect on July 1, 2014. After that date, first-time DUIs may be eligible for nonadjudication (plea bargains) and expungement from your record. However, the “look-back” for repeat offenses will increase to 10 years and the penalties for DUI will be more severe.
