Mississippi is a state that still prosecutes offenders for minor marijuana charges, unlike many other states that have decriminalized or even legalized its recreational use. In fact, a Mississippi appeals court ruling upheld the life sentence without possibility of parole of a man convicted of possession of marijuana.
Given the harsh stance of police and prosecutors, some Mississippi residents may have turned to the use of Delta-9 products to relax and unwind. But are these products legal to possess and use?
Delta-9 and Mississippi laws
For now at least, possession, sale and use of products containing Delta-9 are legal here in Mississippi as long as the products contain less than .3% THC. These products wre legalized with the passage of the federal Farm Bill, SB 2725, that was passed in 2018.
But you could still encounter police problems
One issue with possessing Delta-9 products is that if you have any type of interaction with police and they allege you were impaired by THC, you could still face arrest. The stakes climb even higher if you were stopped by the police while operating a motor vehicle.
Mississippi DUI laws are not restricted to only alcohol consumption. Any substance that can alter the user’s perception and affect their sobriety can be the catalyst for a DUI charge. People have been arrested for DUI after taking OTC medicine to treat their colds.
Another potential problem
If you get stopped by the police and have legally purchased Delta-9 products on your person, the police might still arrest you and you will have to show the court that the product you had was legal.
Know what to do to protect yourself
Many arrested people destroy any hopes of an acquittal by answering police questions without the benefit of first seeking legal counsel. Having someone by your side to run interference with the police is the best way to approach criminal charges.
