Communication is not a strong point for many teenagers, especially males. While that can be frustrating for those who deal with them daily, it can become a much more serious problem when a teen becomes sexually active.
If communication is unclear when sexual activity takes place, it can put a teen at risk of false date rape claims. They may feel they made their intentions clear, and the other party consented, but that person may take a different stance. They may claim they had no way of knowing what the teen was thinking because they never actually came straight out and said it in a way they could understand.
Shyness around the topic can play a role
“Can we have sex?” sounds like a simple question to ask, but some people find it incredibly tough to be so direct. They’re worried it will be seen as too forward, so instead, they fudge the question or try to feel their way into the situation, perhaps intuiting the other person’s wishes and permissions incorrectly. Adults with plenty of experience can have this issue, so it’s not surprising that teens who are perhaps having intimate contact with someone for the first time can struggle.
Alcohol and drunk can make memories hazy
Maybe consent was given, only that the person who gave it does not remember giving it because they had consumed quantities of alcohol or drugs. They might not remember much about the incident at all.
Shame, embarrassment and regret can also play a role
Maybe the person who is now accusing the other person of date rape woke up wishing the encounter had not happened. Rather than face up to their parents, friends, boyfriend or girlfriend and say they slept with someone, they panic and invent a story claiming they had no choice in the matter.
A date rape charge can ruin a teen’s life. Seeking legal help will be essential to examine all defense options available to a young defendant.
